HDDİZAYN Software Information Technologies, hereinafter referred to as "HDDİZAYN" and "wisecptheme.com."
The definitions of Customer and User represent individuals or organizations that purchase products/services through the wisecptheme and wisecptheme.com website.
All customers who create accounts, make purchases, and benefit from the services through www.wisecptheme.com ("Website") or mobile applications are deemed to have read, understood, and accepted the terms listed below. Without accepting all the conditions stated below, it is not possible for users to create an account or make a purchase. All users who create an account and make a purchase accept this agreement and can proceed accordingly.
This agreement is presented for the customer's approval during membership and product/service purchase and does not allow proceeding without acceptance. It is also continuously published at the bottom of the site. It is the customer's responsibility to review and read it.
This agreement imposes rights and obligations on the parties regarding the site subject to the agreement, and when the parties accept this agreement, they accept, declare, and undertake to fulfill these rights and obligations completely, accurately, on time, and under the conditions demanded by this agreement.

RESPONSIBILITIES

1.1 The web software and all related pages on sale on our site are the property of wisecptheme.com and are operated by wisecptheme.com. wisecptheme.com reserves the right to make changes to prices and offered products and services and contracts at any time.
1.2 wisecptheme.com undertakes and guarantees that the member will benefit from the products subject to the agreement, except for technical failures.
1.3 The customer agrees and undertakes not to engage in reverse engineering or any other activities aimed at finding or obtaining the source code of hddizayn products. Otherwise, in case of detection of such an activity, it is accepted and declared that all products currently purchased and the customer's account will be canceled unconditionally and without refund.
1.4 It is forbidden to place fake orders for trial purposes through the site. If detected, their accounts will be canceled, and they will not be able to create an account again with the existing account information.
1.5 The customer agrees and declares that they will pay the fee determined by wisecptheme.com for additional modules, requests, and adjustments to the web software they will purchase. The customer cannot claim rights regarding the additional modules, requests, and adjustments they will have made later. The customer only obtains a usage license for the software and purchases only the right to use the additional modules and requests they have made later. Thus, the customer does not have the right to demand that similar additional modules, adjustments, and requests not be added to another customer or site or used in general sales (unless there is an additional contract or agreement).

INTELLECTUAL PROPERTY RIGHTS

2.1 All intellectual property rights of the titles, business names, brands, patents, logos, designs, and products on this Site, whether registered or unregistered, belong to the site operator and owner company or the specified interested party and are under the protection of national and international law. Visiting this Site or benefiting from the services on this Site does not grant any rights regarding these intellectual property rights.
2.2 All products on the site cannot be reproduced, published, copied, or transferred in any way. The whole or part of the site cannot be used on another website without permission.
2.3 All rights to the visual design and source codes of all products detailed on the site are reserved by the Ministry of Culture and Tourism's General Directorate of Copyright. Sales are carried out only through our website, our dealers' websites, and our authorized business partners.

REGISTRATION AND SECURITY

4.1 The customer is obliged to provide accurate, complete, and up-to-date registration information. Otherwise, this agreement will be considered violated, and the customer account will be terminated without notifying the user.
4.2 The customer is responsible for the security of their passwords and accounts on the site and third-party sites. Otherwise, wisecptheme.com cannot be held responsible for any data loss, security breaches, or damage to hardware and devices.

OTHER TERMS AND CONDITIONS

5.1 The CUSTOMER accepts, declares, and undertakes that they will not engage in any behavior that will damage the commercial reputation, prestige, and dignity of hddizayn and other customers, and if such situations are detected, the customer account and all products and services associated with it will be canceled unconditionally and without refund, and that they will compensate for all damages and losses incurred by hddizayn and its customers.
5.2 The CUSTOMER accepts, declares, and undertakes that they will compensate for all damages and losses incurred by hddizayn against any claims arising from the use of hddizayn's services.
5.3 hddizayn reserves the right to refuse service to anyone who requests it, to cancel all products/services and the customer account by refunding the corresponding amount for the remaining usage of products/services in case of negative (mobbing) behaviors displayed by the customer affecting the performance of hddizayn's authorized personnel and staff. The CUSTOMER accepts and declares this.
5.4 hddizayn will activate the service and notify the CUSTOMER upon the transfer of funds to hddizayn's bank account specified during the order process from the account opened in the name of the person or institution specified in the CUSTOMER's information, if the CUSTOMER chooses to pay by bank transfer. All costs associated with payments are borne by the CUSTOMER.
5.5 All periodic products and services are suspended if payment is not made by the end of the service end date. Products and services that are not paid for within three (3) days following the suspension period are permanently deleted from the system, and no responsibility is accepted. The CUSTOMER accepts and declares this.

TECHNICAL SUPPORT

6.1 hddizayn accepts and declares that it will provide "free support" against errors and problems arising from itself for one month from the date the product/service is purchased by the Customer. Problems caused by interventions made by the customer after the purchase are outside this scope. In such cases, the solution is to restore the product to its standard form provided by hddizayn and reinstall it on the system. The customer is aware of this and accepts and declares it.

6.1 hddizayn accepts and declares that it will provide "free support" against errors and problems arising from itself for one month from the date the product/service is purchased by the Customer. In such cases, the solution is to restore the product to its standard form provided by hddizayn and reinstall it on the system. The customer is aware of this and accepts and declares it.
6.2 The Customer is responsible for obtaining and maintaining all necessary hardware to ensure the smooth operation of the product/service they have received from hddizayn in the "Web Software" service area. This basic hardware is declared to the Customer before and during the purchase. Some products/services may require additional hardware and software features beyond the basic level. The Customer agrees and declares that these additional features stated by hddizayn will also be provided.
6.3 The Customer accepts and declares that they will receive support services for all issues outside the "standard operation" of all purchased products and services for a fee, and that hddizayn may not provide support services in some cases due to workload, even if it is for a fee.
6.4 The Customer accepts and declares that all support requests will be submitted through the "technical support system" available on the wisecptheme.com website and that no support services will be provided otherwise.
6.5 All support requests created by the Customer will be responded to by hddizayn within 24 hours, depending on the workload.

FORCE MAJEURE

7.1 The parties are not responsible if the obligations arising from the contract cannot be fulfilled due to reasons beyond their control, such as natural disasters, fires, explosions, civil wars, wars, uprisings, public movements, mobilization declarations, strikes, lockouts, epidemics, infrastructure and internet failures, and power outages (hereinafter collectively referred to as "Force Majeure"). During this period, the rights and obligations of the parties arising from this Agreement are suspended.

INTEGRITY AND APPLICABILITY OF THE CONTRACT

10.1 If any provision of this agreement becomes partially or completely invalid, the remainder of the agreement will continue to be valid.

CHANGES TO THE AGREEMENT

11.1 wisecptheme.com may partially or completely change the products and services offered on the site and the terms of this agreement at any time. Changes will be effective from the date they are published on the site. It is the user's responsibility to follow and check the changes. By continuing to benefit from the services offered, the user is deemed to have accepted these changes.

NOTIFICATION

12.1 All notifications to be sent to the parties regarding this Agreement will be made via the known email address of wisecptheme.com and the email address specified by the user in the membership form. The user accepts that the address they specified during membership is a valid notification address, and if it changes, they will notify the other party in writing within 5 days, otherwise, notifications made to this address will be considered valid.

EVIDENCE AGREEMENT

13.1 In any disputes that may arise regarding transactions related to this agreement, the parties accept that the parties' books, records, and documents, as well as computer records and fax records, will be accepted as evidence in accordance with the Code of Civil Procedure No. 6100, and the user accepts not to object to these records.

CANCELLATION/RETURN/WITHDRAWAL RIGHT

14.1 Cancellation, Return, and Withdrawal Right for Software Products:
According to the Consumer Rights Law and Article 15 (ğ) of the Regulation on Distance Contracts (see: [http://www.resmigazete.gov.tr/eskiler/2014/11/20141127-6.htm]), the Customer cannot use the right of cancellation, return, or withdrawal after purchasing the software product in question. For a cancellation, return, or withdrawal to be possible, there must be an irreparable grievance regarding the software. Any lack of features or qualities that the software does not possess, or the inability of non-experts to make adjustments requiring expertise on the product, cannot be presented as a problem or defect. The Customer is obliged to thoroughly examine whether the software is suitable for their needs before purchasing and to request information if necessary. The Customer accepts and undertakes this.
14.2 License Change in Software Products:
Software products are licensed to the domain address specified by the customer at the time of purchase. After the licensing process, the domain address cannot be changed under any circumstances. The Customer accepts and undertakes this in advance.
14.3 License Transfer/Assignment in Software Products:
The Customer cannot transfer/assign their software license to another person under any circumstances, nor can they sell it. The Customer accepts and undertakes this in advance.
14.4 Rented Software Products:
In software products rented on a monthly basis or for a period longer than one month, no license information changes, license transfers/assignments can be made. The Customer accepts and undertakes this.
14.5 The Customer has no right to withdraw, cancel, change, or request a refund for the following products/services unless there is any issue or grievance caused by our company:
Other local and international product/service licenses.
14.7 If payments are made by credit card or a similar payment card, the consumer can request the cancellation of the payment transaction on the grounds that the card has been used unlawfully and without their consent. In this case, the card-issuing institution returns the payment amount to the consumer within 10 days of notification of the objection.

RESOLUTION OF DISPUTES
15.1 Istanbul (Central) Courthouse Courts and Enforcement Offices have jurisdiction over any disputes arising from the implementation or interpretation of this Agreement.
